    1. The Student Rule:

      A household entirely comprised of full-time students is generally not eligible for LIHTC housing.

    2. Definition of a Full-Time Student:

      An individual is considered a full-time student if they are enrolled as a full-time student at an educational organization (including K-12 schools and higher education institutions) for any portion of five months within a calendar year.

      The months don't need to be consecutive, and a month is counted if the student attends even one day.

      The educational institution's criteria for full-time status generally apply. 

    3. Exemptions to the Student Rule:

    Full-time students may still be eligible if they meet certain exceptions. These include: 

    • Receiving TANF assistance.

    • Participating in a job training program with assistance.

    • Being a former foster youth.

    • Being a single parent household, where neither the parent nor the children are dependents of another individual (except for the other parent).

    • Being a married couple eligible to file a joint tax return.

    • Having been previously in foster care. 

    We must verify student status at move-in and annually, and must also verify that any full-time student households meet one of the exemptions. These rules ensure LIHTC housing serves its intended purpose.
